Description

1. Divorce ? Judges. Jurisdiction on disqualification of judges. A non-resident judge in a divorce proceedings who was called in after a previous judge in the original proceeding had been disqualified had jurisdiction to hear motion for modification of alimony provision of decree. 2. Divorce. Alimony ? Change of husbands financial position. Where a substitute judge presided over a suit for divorce and entered judgment therein, he had jurisdiction to hear and deny husbands later separate motion for modification of decree as to alimony so that another judge, substituted for first to hear second motion made by husband 35 days later, properly considered only question whether husbands position had changed since first motion and, when he found no change, properly ruled that matter was settled so far as district court was concerned. 3. Divorce. Evidence showed no abuse of discretion. Evidence showed there was no abuse of discretion in the finding that there was no substantial change in the husbands financial status which would justify modification of the decree. 4. Divorce. Effect of suit to quiet title. Mere pendency of suit to quiet title did not show change in husbands financial status which would entitle him to modification of divorce decree as to alimony.
